Ms. Lenora Addison-Miles, Administrator for the Engineers and Surveyors Board at SC Department of Labor, Licensing and Regulation and Ms. Sara McCartha, Office of Advice Counsel for LLR presented Engineers and LLR – Licensing, Examinations, Complaint Process, Cease & Desist Orders, Recently Enacted legislation and Proposed Legislation at the joint ACEC-SC/SCSPE Winter Meeting.

Here are a few highlights:
1. There are 15,550 registered engineers in SC as of 06/30/14 – 5,151 are In-state and 10,389 are out of State.
2. LLR received 2,154 applications in 2013 averaging 179 per month.
3. In April 2013, the PE Exam Performance was as follows:
a. Civil
i. 51 First Time takers with 62.7% passing. The National Average was 70%.
ii. 49 Repeat takers with 38.8% passing. The national average was 37% INSERT JUMP
b. Electrical
i. 12 First time takers with 50% passing. The national average was 64.4%.
ii. 9 Repeat takers with 33.3% passing. The national average was 34.9%.
c. Mechanical
i. 13 First time takers with 61.5% passing. The national average was 70%
ii. 8 Repeat takers with 37.5% passing. The national Average was 39.6%.
4. In October 2013, the PE Exam Performance was as follows:
a. Civil
i. 60 First Time takers with 58.3% passing. The National Average was 64.1%.
ii. 34 Repeat takers with 26.5% passing. The national average was 28.6%
b. Electrical
i. 13 First time takers with 69.2% passing. The national average was 62.6%.
ii. 7 Repeat takers with 57.1% passing. The national average was 27.7%.
c. Mechanical
i. 23 First time takers with 78.3% passing. The national average was 71.5%
ii. 6 Repeat takers with 50% passing. The national average was 41%.
d. Structural
i. Vertical – 2 Repeat takers with 100% passing. The national average was 34.3%
ii. Lateral – 2 first time takers with 100% passing. The national average was 37.5%.
iii. Lateral – 4 Repeat takers with 100% passing. The national average was 42.8%
5. In 2013, there were seven request approved for Education and Research Fund for a total of $96,175 for Educational Conferences, speakers and venue. The current balance as of January 2014 is $257,972.
6. Complaint Process:
a. When filing a complaint, it takes approximately 7 days to determine if a violation has occurred.
b. If the Complaint is determined by the analyst (who is an attorney) as a potential violation, the case is assigned to an Investigator.
c. Within 30 days of the assignment, the licensee will receive a letter which includes detail of the allegations and request a written response from the licensee.
i. The reply to the investigator is the respondent’s opportunity to communicate to the agency his or her version of the events leading up to the complaint.
ii. Any communication provided to the agency may be used in a legal proceeding and investigator may issue subpoenas sunder SC Code 40-1-80(B)
iii. Many respondents choose to retain council.
iv. Investigations are typically complete within 60-180 days.
